NY Supreme Court Allows Texas to Bus Migrants to NYC

(LibertySociety.com) – The New York Supreme Court last week rejected New York City Mayor Eric Adams’ request to block the bus companies that are bringing migrants to his city.

The mayor sought an injunction to prevent the Texas-based companies from transporting the migrants Governor Greg Abbott had been sending to New York from the southern border.

Adams filed suit against 17 charter bus companies in January, seeking more than $700 million to cover the costs associated with the thousands of asylum seekers transported to New York City since 2022.

The mayor accused the companies of engaging in “bad faith” conduct and claimed that they were violating the state’s Social Services Law by dropping thousands of migrants in the city without providing support.

At the time, Adams blamed Governor Abbott, claiming that he was using the migrants as “political pawns” to sow chaos.

Mayor Adams’ office filed the lawsuit after Governor Abbott bypassed the mayor’s executive order that limited the times and days buses could deliver migrants to New York. To get around the order, Abbott had the bus companies transport the migrants to train stations in New Jersey where they could then catch trains to the city.

The mayor asked the New York Supreme Court to impose a preliminary injunction preventing the bus companies from transporting the migrants. However, the request was challenged by the New York Civil Liberties Union (NYCLU), which argued that the mayor’s request was unconstitutional.

The Supreme Court agreed with the NYCLU and denied the injunction.

NYCLU senior attorney Beth Haroules lauded the Court’s decision, saying in a statement that the mayor’s request was a “cruel attempt” to limit the number of migrants seeking a home in New York City.

Haroules said the state Supreme Court recognized the city’s history of “providing shelter” and welcoming immigrants.

The mayor’s office said it would respect the Supreme Court’s decision but insisted that the mayor’s lawsuit had already helped to reduce the number of buses arriving in New York.
