(LibertySociety.com) – The First Amendment affords every citizen the right to free speech, but it does have its limitations. A person can’t use his words to affect public safety, like yelling fire in a crowded place where there is none, and he cannot use his words to defame someone’s character. According to famed attorney Todd McMurtry, Kyle Rittenhouse may have a strong defamation case against President Joe Biden for implying the teen was a white supremacist while the statesman ran for office.
McMurtry won a similar case in 2018, when a tweeted video of his client, Nick Sandmann, unjustly portrayed him as harassing a Native American veteran.
Joe Biden still has not apologized for calling Kyle Rittenhouse a white supremacist, and he never will.

On November 23, during a briefing, White House Press Secretary Jen Psaki made it clear Biden already spoke about the 18-year-old’s not guilty verdict and has no intention of apologizing.
Many on the Right are calling for Biden to apologize, including Rittenhouse’s mother, Wendy, who said the President “defamed him” on Hannity. The teen himself appeared on Tucker Carlson, asking the leader to be sure he “understood the facts” of a situation before speaking about it.
During the same Tucker Carlson segment, Rittenhouse alluded to having “very strong” lawyers potentially handling defamation lawsuits soon. McMurtry called the suit actionable.
