(LibertySociety.com) – Democrats forced a DHS shutdown demanding ICE oversight, but accidentally furloughed 60 percent of the very watchdog workforce they claimed to champion—leaving immigration enforcement operations running while independent reviews grind to a halt.
Story Snapshot
- DHS shutdown furloughs 60% of Inspector General staff while ICE continues enforcement with previously allocated funds
- Democratic shutdown strategy backfires as oversight capacity vanishes while the operations they oppose proceed unimpeded
- Secretary Noem retains untapped authority under 1978 law to halt investigations on national security grounds—a power no DHS secretary has previously invoked
- Over 250,000 DHS employees work without pay as critical reviews of Secret Service failures and cybersecurity threats face indefinite delays
Democratic Strategy Collapses Under Own Weight
The partial government shutdown affecting the Department of Homeland Security began February 15, 2026, after Democrats blocked funding legislation over demands for “dramatic changes” to ICE operations. House Minority Leader Hakeem Jeffries insisted Republicans showed “zero interest in getting ICE under control,” demanding curtailed patrols, face mask bans, and warrant requirements. The gambit spectacularly misfired: ICE received funding through prior reconciliation legislation and continues enforcement activities, while the DHS Office of Inspector General furloughed approximately 60 percent of its workforce—the very oversight mechanism Democrats claimed they were protecting.
Senator Tammy Duckworth exemplifies the contradictory position Democrats now occupy. She demanded an independent investigation into ICE’s Operation Midway Blitz in Chicago, focusing on use-of-force protocols after controversial enforcement actions. Her request was denied. She then wrote to DHS Secretary Kristi Noem warning about threats to OIG independence, citing a 1978 law allowing cabinet secretaries to halt inspector general investigations on national security grounds. Duckworth argued this provision provides “a broad range of pretextual options” to stop independent reviews, though no DHS secretary has ever invoked this authority. Her solution? Force a shutdown that accomplishes exactly what she feared—halting independent oversight.
Oversight Apparatus Dismantled by Its Defenders
With 60 percent of OIG personnel furloughed, only special agents conducting criminal investigations and staff supported by secondary funding continue working. Oversight reviews, audits, and data analysis are effectively paused. Mark Greenblatt, former Department of Interior Inspector General dismissed by President Trump in 2024, notes the shutdown forces IG offices to “pause oversight reviews, ceding valuable time on sensitive audits.” Critical investigations now stalled include reviews of Secret Service handling of the July 2024 assassination attempt against Trump, DHS cybersecurity protocols, and counterintelligence operations. Meanwhile, ICE enforcement proceeds without interruption using previously appropriated funds.
This marks the third shutdown of Trump’s second term, following a record 43-day closure in October 2025. During the previous shutdown, ICE furloughed its congressional relations team and blocked lawmakers from visiting detention facilities—a pattern now repeating. Historical precedent suggests Democrats will find themselves locked out of the very facilities they demanded to inspect. The Council of the Inspectors General on Integrity and Efficiency has advocated for years for statutory authority allowing inspectors general to continue operations during shutdowns, recognizing this structural vulnerability. Democrats ignored this institutional wisdom and weaponized the funding process instead.
Operational Reality Exposes Political Theater
Senator John Fetterman broke Democratic ranks with a dose of reality: “This shutdown literally has zero impact on ICE.” He’s correct. Immigration and Customs Enforcement, along with Customs and Border Protection, operate using funds secured through reconciliation in previous spending legislation. ICE agents continue enforcement operations, detentions proceed, and immigration enforcement remains fully operational. What Democrats successfully shut down are the administrative functions, disaster response capacity, cybersecurity modernization, and transportation security improvements—none of which relate to their stated concerns about ICE tactics.
The Transportation Security Administration warns prolonged shutdowns could increase airport wait times and potentially cancel flights. FEMA faces constraints on disaster response capabilities. USCIS Director Joe Edlow announced the agency is reprioritizing resources toward national security vetting while delaying interviews, naturalization ceremonies, and contact center responses. Over 250,000 DHS employees work without pay. House Appropriations Committee Republicans correctly note the shutdown “would disproportionately harm DHS’s other components, which are responsible for disaster response, cybersecurity, transportation security, and infrastructure protection.” Democrats achieved the opposite of their stated objective—they eliminated oversight while harming Americans and leaving enforcement intact.
Constitutional Accountability Versus Political Stunts
This fiasco illustrates why voters rejected Democratic governance in 2024. Rather than work within constitutional frameworks to address legitimate oversight concerns through appropriations riders, investigative hearings, or legislative reforms, Democrats chose the blunt instrument of shutdown politics. The result vindicates President Trump’s approach: ICE continues protecting Americans from illegal immigration while Democrats fumble their own oversight tools. White House Press Secretary Karoline Leavitt accurately describes Democrats as “barreling our government towards another shutdown for political and partisan reasons.” The evidence supports her assessment completely.
