County Sued for Failing to Remove Illegal Immigrants from Voting Lists

(LibertySociety.com) – Conservative group America First Legal filed a lawsuit last week against Maricopa County accusing election officials of refusing to take steps to prevent illegal aliens from voting in national elections.

The lawsuit, filed on August 5 in Arizona Superior Court against outgoing County Recorder Stephen Richer on behalf of Strong Communities Foundation of Arizona, comes weeks after America First Legal sent letters to election officials in all 15 Arizona counties reminding them of their legal obligation to prevent foreign nationals from voting in elections.

The group gave the counties a week to take additional steps to purge voter rolls of those not eligible to vote. However, in his response, Richer told the group that his office would not be taking any further action as it already complies with the law, according to an August 7 press release from America First Legal.

The group maintains that Richer’s claims are incorrect, arguing that the Maricopa County voter rolls include those whose citizenship had not been confirmed.

America First Legal President Stephen Miller accused Maricopa County officials of directly violating state law by refusing to purge illegal aliens from the voter rolls. He said the lawsuit alleges that election officials are “unlawfully permitting illegal aliens and foreign citizens to interfere” in the upcoming election.

Under Arizona law, voters are required to present documentation proving citizenship, such as a birth certificate or passport, to register to vote. County recorders are required to use “all available resources” to confirm that those registering are US citizens. This includes checking the status of registered voters against the Department of Homeland Security’s immigration status verification service.

Voter rolls are also regularly checked against information from the Social Security Administration, the Postal Service, and state agencies like the Departments of Health Services and Transportation, as well as records from the Jury Commissioner’s Office in each county.

A spokeswoman for the Maricopa County Recorder’s Office told AZ Central that the county maintains up-to-date and accurate voter rolls. Since January 2021, more than 400,000 names have been removed from the voter rolls, the spokeswoman added.
